You may use the Qualbound website for lawful business and informational purposes.

We reserve the right to restrict or terminate access to the website where we reasonably believe these Terms have been violated.

3. Our Services

Qualbound provides professional services based on the scope agreed with each client.

Because every business, market, product, and growth situation is different, recommendations and deliverables may vary from one engagement to another.

We may provide services through:

  • Fixed-scope projects
  • Strategy engagements
  • Project sprints
  • Monthly engagements
  • Ongoing growth partnerships
  • Other commercial arrangements agreed in writing

The applicable client agreement will take precedence over these general Terms where the two conflict.

4. Proposals and Statements of Work

Before beginning a paid engagement, Qualbound may provide a proposal, quotation, statement of work, or service agreement.

The applicable document may specify:

  • Scope of work
  • Deliverables
  • Project milestones
  • Timeline
  • Fees
  • Payment schedule
  • Client responsibilities
  • Revision limits
  • Third-party costs
  • Ownership and intellectual property terms
  • Termination conditions

A project becomes binding when the applicable agreement has been accepted by both parties or when the client has otherwise formally engaged Qualbound.

5. Fees and Payment

Fees for Qualbound services will be communicated before the engagement begins.

Depending on the engagement, payment may be structured as:

Fixed Project Fee

A predetermined fee for a defined scope and set of deliverables.

Sprint-Based Engagement

A fee for a defined period or growth sprint with specific objectives and deliverables.

Ongoing Engagement

A recurring fee for continued strategy, execution, consulting, or growth support.

Unless otherwise stated in writing:

  • Invoices are payable according to the agreed payment terms.
  • Work may be paused if payments become overdue.
  • Third-party costs may be billed separately.
  • Additional work outside the agreed scope may require additional fees.
  • Taxes, duties, or applicable government charges may be payable by the client where applicable.

6. Scope Changes

Qualbound will perform the work described in the agreed scope.

Requests that materially change the scope may require:

  • Additional fees
  • Additional time
  • A revised statement of work
  • A new project or sprint

We will communicate material scope changes before undertaking significant additional work whenever reasonably possible.

7. Client Responsibilities

Successful growth projects require participation from both Qualbound and the client.

The client is responsible for providing accurate and timely:

  • Information
  • Access credentials
  • Brand assets
  • Content
  • Business information
  • Customer information where appropriate
  • Technical information
  • Feedback
  • Approvals
  • Other materials reasonably required to complete the work

Delays in providing required information, approvals, or access may affect project timelines.

Qualbound is not responsible for delays caused by the client’s failure to provide required materials or approvals.

8. Third-Party Platforms

Qualbound may use or work with third-party platforms and services, including but not limited to:

  • Google Analytics
  • Microsoft Clarity
  • Zoho Bigin
  • Calendly
  • Website hosting platforms
  • CMS platforms
  • Marketing platforms
  • SEO tools
  • Advertising platforms
  • Analytics and automation tools
  • Other software required for an engagement

Third-party platforms are controlled by their respective providers.

Qualbound cannot guarantee the continued availability, functionality, pricing, policies, or performance of third-party services.

Where a third-party service is required for your project, additional subscription or usage fees may apply.

9. Website Development

For website development projects, the agreed scope will determine the specific deliverables.

Unless otherwise agreed:

  • The client is responsible for providing accurate business information and required content.
  • Third-party themes, plugins, software, hosting, domains, or licenses may involve additional costs.
  • Qualbound does not guarantee uninterrupted operation of third-party hosting or software.
  • Website performance may depend on hosting, plugins, third-party services, infrastructure, and factors outside Qualbound’s control.

The client is responsible for maintaining licenses and subscriptions that are registered directly to the client.

10. SEO and Growth Services

SEO, marketing, demand generation, and growth services involve variables outside Qualbound’s control.

We do not guarantee:

  • Specific search engine rankings
  • Specific traffic levels
  • A specific number of leads
  • A specific number of customers
  • A specific conversion rate
  • A specific return on investment
  • A specific revenue amount
  • Reaching $1M or any other revenue milestone

Our positioning, “Your First $1 Million Is Our Mission,” represents our strategic focus and ambition for the businesses we work with. It is not a guarantee of revenue or business performance.

Results can be influenced by market conditions, competition, pricing, product-market fit, sales execution, customer behaviour, budgets, economic conditions, search-engine algorithms, advertising platforms, and many other factors.

11. Market Research and Strategic Recommendations

Qualbound may provide research, analysis, forecasts, recommendations, and strategic opinions.

These are developed using information and methodologies we consider appropriate for the engagement.

However, market conditions can change rapidly.

Qualbound does not guarantee that:

  • Market information will remain unchanged
  • Competitor behaviour will remain unchanged
  • Forecasts will materialize
  • Recommendations will produce a specific commercial outcome

Clients remain responsible for their own business decisions and investments.

12. Artificial Intelligence and Technology

Qualbound may use artificial intelligence tools, automation, software, and technology as part of research, analysis, ideation, content development, design, development, or other services.

Where AI-assisted tools are used, Qualbound may review, refine, validate, or modify outputs as appropriate.

AI-generated or AI-assisted outputs may contain errors, omissions, or inaccuracies.

Clients should review important business, legal, financial, technical, or customer-facing materials before relying on them.

13. Intellectual Property

Unless otherwise specified in a written agreement:

Client Materials

You retain ownership of materials and information that you provide to Qualbound.

You grant Qualbound the necessary rights to use those materials to perform the agreed services.

Qualbound Materials

Qualbound retains ownership of its pre-existing:

  • Frameworks
  • Methodologies
  • Processes
  • Templates
  • Tools
  • Systems
  • Know-how
  • Strategies
  • General concepts
  • Proprietary materials

Project Deliverables

Ownership of final project deliverables will be governed by the applicable proposal, statement of work, or service agreement.

Where appropriate and subject to full payment, Qualbound may transfer agreed rights in final deliverables to the client.

14. Portfolio and Case Studies

Unless otherwise agreed in writing, Qualbound may reference completed work in its portfolio and marketing materials.

This may include:

  • Client name
  • Company logo
  • General description of work
  • Publicly available information
  • Non-confidential results

We will not intentionally disclose confidential client information.

If a client requires complete confidentiality or does not want its name or work used publicly, this should be agreed in writing.

15. Confidentiality

Both parties may receive confidential information during an engagement.

Each party agrees to use reasonable care to protect confidential information and not disclose it to unauthorized parties except:

  • With permission
  • To necessary professional advisers or service providers
  • Where required by law
  • Where the information is already publicly available through no breach of confidentiality

Specific confidentiality obligations may be established through a separate NDA or service agreement.

16. Communications

By submitting an inquiry or requesting information from Qualbound, you agree that we may contact you regarding your inquiry or requested services.

Where permitted by applicable law, we may also send relevant business or marketing communications.

You can opt out of marketing communications at any time.

For more information about how we process personal information, please see our Privacy Policy.

17. Cancellation and Termination

The cancellation or termination terms for a paid engagement will normally be specified in the applicable service agreement.

If no specific termination terms have been agreed, either party may request termination by providing reasonable written notice.

Upon termination:

  • Fees for completed work remain payable.
  • Approved or committed third-party costs remain payable where applicable.
  • Work may cease once the termination becomes effective.
  • Deliverables will be provided according to the applicable agreement and payment status.

Certain provisions, including confidentiality, intellectual property, payment obligations, and limitations of liability, may survive termination.

18. Refunds

Refund eligibility depends on the nature of the service and the applicable agreement.

Because Qualbound provides customized professional services, strategy, research, development, and other work created specifically for individual clients, fees for work already performed are generally non-refundable unless otherwise agreed in writing or required by applicable law.

Any specific refund terms included in a proposal or service agreement will apply to that engagement.

19. No Guarantee of Business Results

Qualbound is a strategic and execution partner, not a guarantor of business performance.

Our work is intended to improve the quality of your growth strategy and execution.

However, we cannot guarantee:

Revenue.
Profit.
Leads.
Customers.
Market share.
Search rankings.
Conversion rates.
ROI.
Funding.
Business valuation.
Any particular growth milestone.

Business outcomes depend on numerous factors beyond our control.

22. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold Qualbound harmless from claims, liabilities, losses, damages, costs, and expenses arising from:

  • Your misuse of our website
  • Your violation of these Terms
  • Your violation of applicable law
  • Materials or information you provide that infringe third-party rights
  • Your unauthorized use of third-party materials or services

This provision does not apply to the extent that the relevant claim results from Qualbound’s own unlawful conduct or other circumstances that cannot legally be excluded.

23. Changes to Our Services

Qualbound may modify, update, suspend, or discontinue parts of the website or services from time to time.

We may also update our service offerings, pricing, processes, and technology.

Changes to an existing client engagement will be governed by the applicable agreement.
